Apostasie im Islam, im Arabischen Ridda (arabisch ردة) oder Irtidād (ارتداد) genannt, bezeichnet den „Abfall vom Islam“. Der Abtrünnige selbst wird Murtadd (مرتد) genannt. Auf Grundlage von Hadithen und Idschmāʿ ist die Apostasie islamrechtlich mit der Todesstrafe zu ahnden, obwohl der Koran selbst keine Strafe im Diesseits vorsieht.[1]

In Ländern, deren staatliche Rechtsordnung sich an der Scharia orientiert, die aber keine islamischen Gerichtshöfe mehr haben, kann der bekundete „Abfall vom islamischen Glauben“ zivilrechtliche (ErbrechtEherecht) und strafrechtliche Konsequenzen haben.

Apostasy in Islam (Arabicردة‎, riddah or ارتدادirtidād) is commonly defined as the conscious abandonment of Islam by a Muslim in word or through deed.[1][2][3] It includes the act of converting to another religion or non-acceptance of faith to be irreligious,[4] by a person who was born in a Muslim family or who had previously accepted Islam.[5] While classical Islamic law has traditionally called for execution for those who refuse to repent of apostasy from Islam, the definition this act and whether and how it should be punished, are matters of controversy and opinions of Islamic scholars differ on these questions.[6][5][7]

According to the classical legal doctrine, apostasy in Islam includes not only an explicit renunciation of the Islamic faith (whether for another religion or irreligiosity), but also any deed or utterance implying unbelief, such as one denying a "fundamental tenet or creed" of Islam.[8] Those who were originally forced to embrace Islam, or who acted as apostates out of fear, or who repented of their apostasy, should not be subject to execution.[9][10]

Until the late 19th century, the vast majority of Sunni and Shia jurists held that for adult men, apostasy from Islam was a crime as well as a sin, an act of treason punishable with the death penalty,[5][11] typically after a waiting period to allow the apostate time to repent and to return to Islam.[5][12][13][14] The kind of apostasy which the jurists generally deemed punishable was of the political kind, although there were considerable legal differences of opinion on this matter.[15] Wael Hallaq states that "[in] a culture whose lynchpin is religion, religious principles and religious morality, apostasy is in some way equivalent to high treason in the modern nation-state".[16] Early Islamic jurists developed legal institutions to circumvent this harsh punishment and the standard for apostasy from Islam was set so high that practically no apostasy verdict could be passed before the 11th century.[17] However, later jurists lowered the bar for applying the death penalty, allowing judges to interpret the apostasy law in different ways,[17] which they did sometimes leniently and sometimes strictly.[18] In the late 19th century, the use of criminal penalties for apostasy fell into disuse, although civil penalties were still applied.[5]

In modern times the majority of modern Islamic jurists continue to regard apostasy not only as a sin but as a crime deserving the death penalty (according to Abdul Rashied Omar),[12] although others[6][5][19] argue its punishment should not be death, or should just be left to God,[20][21][22][23] punishment being inconsistent with Quranic injunctions against compulsion in belief.[24][25] and should be enforced only if apostasy becomes a mechanism of public disobedience and disorder (fitna).[Note 1] Critics[27][28] argue that the death penalty or other punishment for apostasy in Islam is a violation of universal human rights and an issue of freedom of faith and conscience.[20][29]

As of 2019, there are 12 Muslim-majority countries that have the death sentence for apostasy,[30][31][32] whereas in 13 other countries apostasy is illegal and the government prescribes some form of punishment for apostasy including: torture, imprisonment, annulment of marriage, loss of inheritance rights or custody rights, amongst others.[33] From 1985 to 2006, three governments executed four individuals for apostasy from Islam: "one in Sudan in 1985; two in Iran, in 1989 and 1998; and one in Saudi Arabia in 1992."[34] The Tunisian Constitution of 2014 stipulates protection from attacks based on accusations of apostasy.[35] In a Pew Research Center poll, public support for capital punishment for apostasy among Muslims ranged from 78% in Afghanistan to less than 1% in Kazakhstan

در کتاب گات‌ها /هات ۳۱ / بند ۱۱ به صراحت این آزادی دیده می‌شود: «ای خداوند خرد هنگامی که در روز ازل جسم و جان آفریدی و از منش خویش نیروی اندیشه و خرد بخشیدی، زمانی که به تن خاکی روان دمیدی و به انسان نیروی کار کردن و سخن گفتن و رهبری کردن عنایت فرمودی خواستی تا هر کس به دلخواه خود و با کمال آزادی خویش (دین) خود را برگزیند.»

نضر نیچه در مورد زرتشت


 زرتشت پیامبر، مردی سترگ و یگانه‌ای بی‌مانند در تاریخ ادیان گیتی و راستگویی والاتبار و بی‌نظیری از دیدگاه فریدریش ویلهلم نیچه‌، فیلسوف شهیر آلمان است. نیچه‌ای که در جوانی تحت آراء شو پنهاور، نیهیلیسم را تبیین تعریف تولد بشری می‌دانست و مقبول قبول داشت که زندگی بشر مشغله‌ای بی‌معناست سرشار از رنج و متنازع به آن نظر که این جهان فقط بخشی و بخشی بی‌اهمیت از کل واقعیت است به گاه اینکه نیچه با گفتارِنیک زرتشت پیامبر در اوستا آشنا شد دیگر، زندگی را اصلیت زنده می‌دانست و این را کل واقعیت، آنگاه بود که طغیان علیه نیهیلیسم را سرآغازیدن کرد و مومن به اعتقاد زندگی، که باید به تمامی در آن زندگی و هر چه می‌توان از آن بر گفت و این کار را باید بهترین نحو مکرر، تکرار کرد چرا که از دیدگاه اشوزرتشت پیامبر زندگی مبارزه‌ای دایم و تردید ناپذیر میان خیر و شر است و تا بدانجا انسان نیک می‌جنگد که باید زندگی بجنگد و تا آنجا می‌زید تا به والای همای ابرمرد برسد و بخواند آنکه را خواندنی است و باید آنچه بایستنی را.

از دیدگاه نیچه زرتشت پرومتئوسی جدید است در تاریکی و سقوط ذهن بشریت رفته به قهقراء ارتجاع مدرنیته او اندیشه‌ای در گفتار زرتشت می‌بیند که جهش خِرد تا به آستان زمین است اندیشه‌ای که نه تنها نظاره‌گر به سوی خیالات آسمانی و اثیری نیست بلکه با اصالت خاک و زندگی آدم‌ها در غالب آن معبود بشر را می‌بیند و حکومت را نه برازنده حاکمیت که در قامت مرد آسای سو شیانت در عبارت ابر مردی جدید که همانا حکومت آن خون سرخ رنگ حکومت ملت است بر مردم که بادا ملت سروری ظهور ابر مرد مقتدر و راستگو را.


نیچه منقلب شده از راست گفتار خورشید خاور زمین به نگارش زرین‌ترین و ژرف‌ترین شاهکارش دست می‌زند و نام آن کتاب را «چنین گفت زرتشت» می‌گذارد و خود می‌گوید: «من جهان را آفریدم» در این کتاب زرتشت شخصیت فرزانه و به یکم کلام دهایی آتشین و تفکر نورانی است که با زبانی شاعرانه همانگونه که در اوستا است حکمت حکیمانه و خِرد پیامبرانه را در باب معنا و ماهیت هستی و بنیاد هستی‌‌شناسی بیان می‌کند. نیچه از دیدگاه زرتشت با کاویدن معنای نسبت خدا و انسان و دین و اخلاق و فلسفه و علم و معانی وجه معنوی انسان موثر در اثر زندگی می‌بیند.

ارتداد

اگر شخص بالغ، عاقل و مختار، از دین اسلام برگردد؛ از وی خواسته می‌شود که توبه کند و به اسلام برگردد و گر نه، اگر مرد باشد اعدام می‌شود و اگر زن باشد حبس ابد شده و در زمان نمازهای پنجگانه شلاقش می‌زنند، و در معیشت و آب و غذا و لباس آن‌قدر بر او سخت می‌گیرند تا توبه کند.[۲]

از نظر جعفر صادقی فدکی، مرتد کسی است که به دنبال دلیل و برهان و استدلال نیست و فقط دروغ بر اسلام می‌بندد تا دین مسلمانان را ضعیف کند.[۳]

فقهای امامیه، علاوه بر اعدام، عقوبت‌های زیر را برای مردی که مرتد فطری است، در نظر گرفته‌اند: جدایی از همسر و تقسیم اموال بین ورثه. در کتب فقهی برخی جزئیات دربارهٔ این مجازات‌ها، چون مسئله قبول توبه مرتد و عده وفات همسر مورد بررسی قرار گرفته‌اند. ادله مورد تمسک در احکام این باب، علاوه بر اجماع، شماری از روایات هستند. اما چنانچه مردی مرتد ملی باشد، مهلتی برای توبه نمودن او مقرر است و تنها در صورت سرباز زدن از توبه مجازات می‌گردد. در صورت تکرار ارتداد برای بار سوم اعدام او واجب است. مرتد ملی در صورت توبه از کفر خویش، از حکم محجور شدن از تصرف در اموال و فسخ عقد نکاح برکنار خواهد بود، گرچه تجدید عقد با زوجه‌اش نیاز به انقضای مدتی برابر عده طلاق دارد. تمام احکام یاد شده مربوط به مرد مرتد است، اما زنی که مرتد گردد در مورد مجازات وی از نظر فقهای امامیه تفاوتی بین مرتد ملی و فطری وجود ندارد
